Toboa siri: MCA IN KISII SAYS UHURU SMOKES BHANG: Kiogoro Ward Representative, Samuel Onkwani

A Kisii County MCA has been hauled
to court for saying that President
Uhuru Kenyatta smokes marijuana.
Kiogoro ward representative Samuel
Onkwani, a laboratory technologist
turned politician, was arrested on
Sunday.
"People close to Uhuru should
advise him to stop smoking bhang,"
Onkwani allegedly stated at a church
function.
The prosecution told court that
Onkwani, 39, thereby undermined
the authority of President Kenyatta.
Onkwani, a father of five who
graduated from Mombasa Polytechnic
in 1996, is accused of making the
statement on August 28, 2013 at
Kerera village in Kerera.
He has served as a CDF member for
Nyaribari-Chache between 2008 and
2011. He first entered elective
politics in 2007 to vie for councillor
but was not successful.
The prosecution told Kisii Principal
Magistrate Kibet Sambu on Monday
that the ODM politican's words were
calculated and intended to bring
into contempt the lawful authority of
a public officer.
"Any person who, without lawful
excuse, the burden of proof whereof
shall lie upon him, utters, prints,
publishes any words, or does any act
or thing, calculated to bring into
contempt, or to excite defiance of or
disobedience to, the lawful authority
of a public officer or any class of
public officers is guilty of an offence
and is liable for a term not
exceeding three years," states
Chapter 13 Section 132 of the Penal
Code which the prosecutuon intends
to use to press their case.
Onkwani, represented by lawyers
Gideon Nyambati and Isaiah Mosota,
denied the charge.
“I ask the court to release the
accused on reasonable bond, supply
us with witness statements, any
communication intercepted and
documents to be relied on by the
prosecution,” Nyambati told the
court.
The prosecution said it was not
possible to comply because the
investigating officer had not given
them the evidence.
Onkwani was released on Sh20,000
cash bail. The case will be
mentioned on May 14 while the
hearing is on June 3.
