GOVERNORS WANT PAY RISE OR PUSH FOR REFERENDUM

MERU COUNTY: The Government
should reconsider the amount of
money going to counties, otherwise
governors will push for a referendum
over revenue allocation, Council of
Governors Secretary Peter Munya has
said.
Speaking during the Meru County
Education Day at Kaaga Girls High
School, Munya said: “Meru county
was only allocated Sh5 billion from
the National Government. Of this,
they use 70 per cent to pay salaries.
We are left with Sh1.8 billion to
transform all the sectors.”
He said the nine sub counties will
each get Sh200 million which is
inadequate.
“We are not going to lie. We are not
happy with how the National
Government is treating us in terms
of allocations. We need more
money,” said the governor. He said if
Jubilee wants to puncture the
opposition’s call for a referendum,
the Government must increase
funding for counties, because “all
counties have tasted development
and nobody wants a reversal of gains
made.”
The Council of Governors said the
Sh226 billion allocated to the
counties is not enough for them to
meet recurrent expenditure and
initiate development projects.
The county bosses have previously
threatened to collect one million
signatures from Kenyans to force the
Government to conduct a
referendum on revenue allocation to
counties. According to the
Constitution, counties should get a
minimum of 15 per cent of the
national revenue.

suffering from
meningitis, a bacterial
infection of the brain,

KENYA”. It sounded astonishing, so
damning like a fellow caught doing
drugs in Singapore.

kitalii hapa jijini Mombasa alijipata
matatani baada ya kupatikana akiwa
na mke wa kiongozi flani mashuhuri
wa hapa nchini. Yasemekana

timing Machozi bila mafanikio lakini
leo siku arobaini zilitimia kwake
msanii huyu mkosa adabu,” read the
Blackstar Entertainment update
whose Facebook link had been
copied to the Pulse editor. In a
nutshell, the writer was insinuating
that Machozi had been having a
secret affair with a top politician’s
wife and after learning of it, the
politician had been tracking the two
all along until this day when he
‘caught them’.
“Msanii huyu alipatikana red handed

concluded and so with an

Nashipai added that ‘utamu wa

yake mbona mwamgeuzia?”

LEAFLETS IN BUSIA KWANGAMOR

Kwangamor village in Teso South,
Busia County are living in fear
following circulation of leaflets
warning of attacks.
The leaflets warned of plans to end
the lives of certain individuals and
destruction of property.
Amukura East ward representative
Dick Omukaga said the locals are
now spending nights in bushes or
sugarcane plantations for fear of
being attacked.
The leaflets were dropped at the
Chief's office and Akobwait trading
centre last Friday bearing the
message: “From Lamu we are coming
to Teso (Akobwait village) to collect
the heads of 36 leaders and we shall
destroy all the property situated
along the road”.

Relief for counties as High Court deal frees funds

Fears of county governments
running dry on funds were eased
on Friday after the Controller of
Budget agreed to release the
money immediately.
The deal was sealed in the High
Court by lawyers representing
Members of County Assemblies,
the Commission on Revenue
Allocation and the Controller of
Budget. Mr Justice Isaac Lenaola
witnessed the signing of the
consent which allowed the county
governments to withdraw half of
their budgets.
According to the consent order,
Controller of Budget Agnes
Odhiambo is to release 50 per cent
of budget estimates for each of the
47 counties budget estimates for
2014/2015 Financial Year, pending
hearing and determination of the
petition.
“The funds must be released
immediately to counties as per
section 134 of the Public Finance
Management Act in respect to
County Budget Estimates for the
2014/2015 financial year,” reads
the order.
Justice Lenaola directed the CRA
and the Controller of Budget to file
their responses before the hearing
of the petition on August 29.
The development is a big relief to
county governments which had
warned that their operations may
grind to a halt if the funds are not
released in the next seven days.
MCAs from all the 47 counties
challenged a directive by the
Commission on Revenue Allocation
curtailing their spending of billions
of shillings.
Their lawyer, Prof Tom Ojienda,
submitted that CRA and the
Controller of Budget contravened
the Constitution as they had no
authority to direct how counties
spent the funds.
“The mandate of CRA is only to
recommend the basis for equitable
sharing of revenue raised by the
National Government to the
devolved governments.
“The Controller of Budget is only
mandated to ensure the funds are
released and has no mandate
deciding how the assemblies will
use them,” Prof Ojienda said.
Last month, CRA issued a directive
on budget ceilings to restrict
spending by MCAs and assemblies
following an outcry over wastage
of public funds through allowances
and foreign trips.
Under the new ceiling, the total
cost for funding new structures
under devolved units should not
exceed Sh13 billion of the total
amount allocated per year for the
executives and Sh17 billion for the
assemblies.
Curb misuse
The ceilings provided a limit of
spending by county executives and
county assemblies in a move meant
to curb misuse of resources and
cut down unnecessary recruitment
at the county governments.
The suit seeks orders suspending
the circular issued by the CRA and
an order compelling the Controller
of Budget to release county funds
as per the 2014/2015 budgetary
allocation for county governments.

Road Accident in Kisumu East Near Nyamasaria at Rabuor

fatal
road
accident
that
occurred on 16.5.12 at around 8.00
am between 62 seater bus and a 14
seater nissan matatu at Rabuor next
to Nyamasaria in Kisumu.The nissan
was heading to Ahero. The bus
heading to Busia from Mombasa
avoided colliding with a matatu that
had stopped dangerously by the
road side to pick a passenger thus
collided with an oncoming
matatu.The bus veered off the
road ,rolled before landing on its
side killing two people instantly.
The West Kenya Region and Eplus
rushed 20 passengers who
succumbed to multiple injuries to
New Nyanza General Hospital.

Kipkaren | Webuye accident

At least four people lost their lives
and 15 others were injured after a
truck lost control and overturned
at Kipkaren market near Webuye
on Sunday.
The affected people were trapped
beneath the truck and all of them
have since been removed and
taken to hospital according to
Kenya RedCross officials.
Kenya RedCross Director of
External Relations and Resource
Mobilization Wario Waita said
RedCross volunteers have managed
to take all the people who were
injured to hospital.
Sunday is a market day in
Kipkaren area hence the high
number of people affected by the
accident.
The late evening incident
happened after the lorry said was
destined to Malaba lost its breaks
and crushed people by the road
side.
Struggled uphill
According to eye witnesses the
lorry was loaded and while it
struggled uphill, it reversed at a
high speed and overturned, hence
causing deaths.
"The lorry was heavily loaded and
upon losing breaks, it reversed so
fast and toppled, crashing those on
the way side," said Japhet
Elichotigo, an eye witness.
Police arrived at the scene and
collected bodies, among them a
young boy between ages of 12 and
15.
The number of people dying on
road accidents remains high in
Kenya despite efforts by the
government to bring it down.

on Friday urged the High Court to
punish two MPs for funding
hawkers to reconstruct sheds
demolished by county askaris.
Mr Mbugua said Nakuru Town
East MP David Gikaria and his
Nakuru Town West counterpart
Samuel Arama blatantly
disregarded court orders last
weekend and led hawkers in
reconstructing the sheds on road
reserves.
According to Mr Mbugua, the
orders issued by Justice Hellen
Omondi had directed the county
government and Mr Gikaria to
maintain the status quo whereby
no more demolition should take
place and no shed should be
rebuilt.
Through lawyer Tom Ojienda, the
governor said the two MPs had
vowed to continue providing funds
for reconstructing, saying it was
against his pledge to Nakuru
residents to make the town as
"clean as it was in the seventies."
TOWN'S IMAGE 'TARNISHED'
Mr Mbugua said the order denied
him a chance to "clean" all towns
of unplanned "ugly" structures he
blamed for insecurity.
“The legislator has been assisting
vendors to rebuild the demolished
structures,” Mr Ojienda told court.
Mr Gikaria obtained an injunction
stopping the demolitions, saying
poor hawkers had no other source
of income.
The court directed that the two
MPs attend court on November 12,
when the application seeking to
stop the demolitions will be heard.
But Mr Mbugua said all stalls
within the Central Business District
would be demolished on the
grounds that they were tarnishing
the town’s image and that they
hampered his government’s bid to
make Nakuru secure and investor-
friendly.
SELF-HELP GROUPS
The demolitions first started in the
industrial area section of the town,
targeting hundreds of makeshift
food kiosks constructed next to the
busy Nakuru-Eldoret highway.
He urged traders to form self-help
groups, which they would use to
engage the planning department in
seeking solutions to the challenges
related to hawking.
The governor said the county
government would only allow
"beautifully made" stalls to be
constructed on selected road
reserves, saying haphazard
constructions had made the town,
once voted as the cleanest in
Africa, ugly and filthy.
In the past few months, stalls have
also been demolished around
Nakuru’s Afraha Stadium, Shabab
area, Langa Langa, Free Area,
Kiundu and Barnabas in the
outskirts of the town.

Odinga immortalised as Bondo University College gets Charter

President Kibaki signs the Charter
at Jaramogi Oginga Odinga
University of Science and
Technology.
Excitement engulfed Bondo town a
couple of days ago when President
Mwai Kibaki granted a Charter to
Bondo University College and
renamed it Jaramogi Oginga Odinga
University of Science and Technology
(JOOUST). It now becomes the 16th
full-fledged public university in
Kenya.
The President who arrived in the
company of Prime Minister, Raila
Odinga and a host of other local
leaders had earlier in the morning
laid a wreath of flowers at the
mausoleum of Oginga Odinga
(Kang’o Ka Jaramogi) before
proceeding to the university to
honour and immortalise the
country’s founding Vice- President.
He was given a rousing welcome by
members of the university
management, local leaders and the
neighbouring community before
signing the charter and visitors’
book. The Head of State viewed a
display of the university’s master
plan, planted a ceremonial tree and
unveiled a plaque to commemorate
the award of the Charter. He also
cut a ribbon and unveiled a
commemorative plaque to officially
open the new Bondo Hostels before
being taken on a guided tour of the
university by the acting Vice-
Chancellor, Prof. Stephen Gaya
Agong’. The President and his
entourage then proceeded to the
main dais in a procession led by the
Kenya Police Band where the main
events of the day kicked off in
earnest.
A series of activities including
entertainment and speeches were
undertaken before the Secretary to
the Commission for University
Education (CUE), Prof David Some
invited the President to read the
Citationand award the Charter and
present Instruments of Authority
(Mace, Logo and Seal) and
Accreditation Report to the
Chairman of JOOUST Council
Chairman, Titus Gateere.
Gateere received the instruments
before installing Prof Jonathan Ole
Karei as the new Chancellor of
JOOUST who then passed on the
above instruments to Prof. Agong’.
Wild cheers and ululations rent the
air when Prof Agong’ carried the
Mace aloft for members of
congregation to see.
Lands Minister, James Orengo and
his Immigration counterpart, Otieno
Kajwang’ who were present during
the event thanked the President for
elevating the institution to a full-
fledged university status adding that
no leader in the history of the
country had ever transformed the
Education sector the way Kibaki had
done. They wished him well in his
retirement. Regional Development
Minister, Fred Gumo challenged
residents of Bondo to work hard in
academics in order to get admission
to the university warning that the
facility won’t admit any student
without the right qualifications.
Higher Education, Science and
Technology Minister, Prof Margaret
Kamar reminded students that being
in the university was an opportunity
of a lifetime and warned them never
to waste or squander it. She noted
that the location of the university
provided a good opportunity to carry
out water research and engage in
agri-business, production of
renewable energy and international
tourism.
The outgoing area MP, Dr Oburu
Odingawho spoke on behalf of the
Odinga family being the eldest, gave
a moving account on how they had
struggled to bring the university to
Bondo. Dr Oburu who is also the
Finance Assistant Minister thanked
Kibaki for elevating the institution to
a full-fledged university and for
immortalising Oginga Odinga. Dr
Oburu described his late father as a
lover of education and a
mathematician of outstanding
repute. Raila narrated to the packed
and attentive audience how his
father used to trek a distance of 30
miles from Maranda to Maseno
carrying a desk to do examinations
in the late 20s and early 30s.
He thanked Kibaki for elevating the
university and naming it after his
father adding that it was the most
befitting honour to the late Jaramogi
Oginga Odinga. Raila called on
universities in the country to
develop products that will aid
industrialisation adding that the
issue of quality and relevance in
training must be addressed.
When he rose to speak, Kibaki gave a
glowing tribute to the late Oginga
Odinga describing him as one of the
most patriotic and gallant heroes in
the country’s history of liberation
struggle and the return to multi-
party politics in 1992.
“I got to know Oginga Odinga when
I was lecturing Economics at
Makerere University in Uganda. He
used to visit us on a number of
occasions to encourage us to come
back home and join the
independence struggle.
Eventually, I agreed, came back to
the country and he appointed me
the Executive Officer of KANU. I am
so indebted to him because he
convinced me to leave my teaching
job and join politics,” recounted
Kibaki. He urged students of the
university to emulate and live by the
ideals that Oginga Odinga stood for
in life.
Kibaki called on members of the
university management to
continuously benchmark with the
best universities all over the world
in matters of science and technology.
He also urged the university to carry
out research on malaria and water
borne diseases that are prevalent in
Nyanza Province. He encouraged
both foreign and local investors to
partner with universities in provision
of quality education.

collapsed and died in a plane at
the Eldoret Airport on Wednesday
morning just as he was about to fly
to Nairobi.
Doctors tried to resuscitate in vain.
Prof Jonathan ole Karei is the
institution’s first chancellor after
his appointment by former
President Mwai Kibaki.
The university’s vice-chancellor
Prof Stephen Agong said the death
came as a surprise.
“The death of Prof ole Karei is
most untimely, coming just after
his appointment and officiating our
inaugural graduation ceremony in
May this year.
"We have received with shock and
disbelief the sad news of the
sudden death of our chancellor,”
he said in a press statement.
“The entire Jooust fraternity will
remember Prof ole Karei as an
astute scholar, a humble leader
and a selfless philanthropist who
has touched the lives many
intellectuals and ordinary people
alike,” he said.
Prof ole Karei graduated with a
Bachelor of Arts degree in political
science and history from the US-
based Philander Smith College in
1963.
He was appointed assistant
professor of Political Science and
Geography at the Voorhees College
in 1966.
He then served in South Carolina
State University between 1974 and
1977 before he was appointed the
chief academic officer of Moi
University between 1984 and 2013.

When The Condom Breaks During Sex

There are times when in the heat of
the moment something goes wrong.
Sometimes the CD is too old or
damaged hence it breaks. Other
times it is not put on properly
which can cause a malfunction as
well. So if you find yourself in this
predicament, what do you do next?
When a CD breaks the partners
involved are at risk for HIV and
other STDs as well as pregnancy.
There are some responsible actions
that you can take to reduce your
risk of getting any of them.

HIV Prevention: The first thing
that both you and your partnern
should do when a CD breaks is go
pee and carefully wash your private
tools. Then you and your partner
should get tested and it should be
done as soon as possible and then
again after three months. You
should also ask the doctor for a
PEP (postexposure prophylaxis)
which is an HIV treatment for the
morning after an accident. It’s
expensive but worth it.
The treatment is taken over a
month and should be started right
away. They are still effective 72
hours after a c0ndom breaks but
are most effective when taken
immediately. The treatment does
have side effects such as extreme
fatigue and nausea.
Pregnancy Prevention : For the
ladies, the Plan B morning-after pill
is the most effective way to prevent
pregnancy after a CD break
accident. It is most effective when
taken right away but can be taken
up to 72 hours after. It is
recommended that you buy Plan B
before anything happens just so
that you have it on hand instead of
having to make time to go to a
pharmacy after an accident
happens. The side effects of Plan B
include abdominal pain, nausea,
fatigue, menstrual changes, and
headaches.
To prevent accidents from
happening in the first place make
sure that the CDs that you are using
are placed properly, and are not
expired or old. Preventing CD
breaks in the first place is your
first line of defense. Also don’t be
too rough during s*x.

recognition in her room. Neighbors
point a finger at her boyfriend who
raised the alarm but police have
urged members of the public to wait
for the results of the post-mortem
examination.

Names of Lamu attackers

Intelligence reports say that Idris
Kamau, a Kenyan of Kikuyu ethnicity,
was the mastermind of the spate of
terror attacks in Lamu that have so
far claimed 87 lives. This information
is contained in a report prepared by
the National Intelligence Service
(NIS) and sent to police stations in
the Coast region on June 4.
The alert also indicated that a
former Kenya Defence Forces (KDF)
soldier, Abu Jamal, is in charge of a
cell of the Al Shabaab fighters in
Mombasa said to be planning more
attacks in the region.
The report said Kamau and his group
of fighters are currently hiding in
the depths of the vast Boni Forest,
where they are believed to have set
up an operations camp.
The alert said that the attackers
were planning to carry out more
raids in Mokowe and Kipini in Lamu
County, Ijara, Garsen and Malindi in
Kilifi County on unspecified dates.
The brief report, which has been
seen by The Standard on Sunday,
further warned that the planned
attack in Malindi is to be a massive
one involving about 150 fighters
divided into three groups. It further
warned that the two field
commanders of the terror group are
planning to recruit more Muslim
youth in Mombasa to undergo
training for their jihadist causes at
an unestablished location in or near
the port city.
We could not immediately establish
further details about the two Al
Shabaab commanders from security
forces who became uncooperative
when we asked for further
clarification. Although the officers
were not given pictures of the two
suspects, the names constitute a
major development in unravelling
the mystery of the attackers who
have struck fear in the hearts of
Lamu residents.

Andrew Kabogo flaunts her 'babe'

Kiambu Governor William Kabogo's
children, like their father, are not
shy when it comes to showing off
their lavish lifestyles.
A month ago, Heads Up wrote about
Alvin Kabogo, also known as Kabogo
Junior, a student at the University of
Brighton, England; after he posted
his pictures on Instagram.
Recently, we bumped into the
governor's eldest son, Andrew
Kabogo who is a replica of the
father.
Andrew is not an extreme showoff
like his younger brother Alvin, whose
videos and photos on Instagram
have the potential of launching
Kenya's first ever rich kids reality
show.
Andrew 'unveiled' his super-hot
'babe' only known as Sana on his
Twitter page.
On the photo caption, he wrote:
"Happy birthday to the babe..."
We are not quite sure why he ended
the sentence such, but this might
be 'the one' as on a different
occasion, he captions what seems to
be a lunch date photo: "Enjoying
Chinese with the babe!"
Just like his brother Alvin, Andrew is
a big supporter of his father's
political career. His Facebook profile
picture is of him with his dad at a
political function in Kiambu.
Andrew, as expected, went to
Brookhouse School and judging from
his photos, he graduated recently
from a university abroad.
According to his profile, he is
currently based in Mombasa. Andrew
and his babe's relationship now
enters Heads Up's 'To Follow List'.

SCHOLARI: "German is bullshit, nkt"

Brazil boss Luiz Felipe Scolari said
he had experienced the worst day
of his life after seeing his side lose
7-1 at home to Germany in the
World Cup semifinal at Estadio
Mineirao on Tuesday.
Scolari had claimed prior to the
match that his team could cope
without the injured Neymar and
suspended skipper Thiago Silva,
but Brazil soon capitulated against
Joachim Low's men and found itself
5-0 down after half an hour.
"It's the worst day of my life,"
Scolari said after the game. "We
ask for forgiveness for the result
and we thank the fans for their
support even during this defeat."
And he added: "I am responsible
for the catastrophic result. I made
the choices. I am responsible.
After the first goal went in we
became disorganized and after that
it was one goal after another.
There was no time to change
anything.
"This is a loss of catastrophic
proportions, it's the worst loss in
our history, but we have to learn
how to deal with it."
Scolari says Neymar's absence had
nothing to do with the defeat and
admitted that Germany had just
been better than his side.
"Neymar is one of the team, but he
is a striker and he wouldn't have
helped us defend those moves,"
the Brazil boss said. "There's no
reason to think it would have been
different with Neymar.
"Let's not try to find an excuse
with Neymar. What happened is
that Germany imposed themselves
in a few moments which defined
the match. Germany made use of
those moments and it's nothing to
do with Neymar."
The 65-year-old now hopes his
players can pick themselves up in
time for Saturday's match for third
and fourth place against either
Argentina or Netherlands.
"I will have to wait until Saturday
to see how they will react," he
said. "Before that we will look at
this match again to see what went
wrong and how we can improve,

Universities should start projects
that not only advance their
academic mandate, but also benefit
communities, President Kenyatta
said on Wednesday.
Mr Kenyatta said if universities
used their resources prudently,
they would impact lives, both
within and outside their campuses.
This, he said, would be achieved
with strong public-private
partnerships.
“We shall readily support projects
owned by universities but whose
benefits trickle down to
communities around the
institutions. We are impressed at
the ongoing infrastructure projects
at Kenyatta University,” said the
President.
GRADUATE SCHOOL
Mr Kenyatta spoke at the
university on Wednesday when he
opened an administration complex
and unveiled the university’s
graduate school.
The President said the university’s
two hospital projects were the
most innovative health projects by
any university in the country.
He was referring to the 600-bed
KU research and referral hospital
that was commissioned in
November 2012 and will be
complete in October next year.
Work on a 300 bed hospital purely
for children will begin next month.
It was allocated Sh500 million in
the Budget.
Vice chancellor Olive Mugenda said
the infrastructure coming up
would cater for the increasing
enrolment.
“From 15,000 students when I took
over in 2006, we now have 65,000
students. We also opened eight
campuses,” said Prof Mugenda.
